Welcome to Qariyb, the comprehensive Muslim events platform. These Terms of Service govern your use of our platform, including our website, mobile applications, and related services.
1. About Qariyb
1.1 Platform Purpose
Qariyb is a specialized events platform designed to serve the Muslim community worldwide. We facilitate the discovery, creation, management, and attendance of Islamic and Muslim-focused events, including:
- Religious gatherings and lectures
- Educational workshops and conferences
- Community celebrations and festivals
- Charitable fundraising events
- Cultural and social events
1.2 Our Role
Qariyb operates as a marketplace platform connecting event organizers with attendees. We provide the technology and tools but are not the organizer or host of events listed on our Platform. We act as an intermediary facilitating transactions and communications between organizers and attendees.
2. Account Registration and Eligibility
To use Qariyb, you must:
- Be at least 18 years old or have parental/guardian consent
- Provide accurate and complete registration information
- Have the legal capacity to enter into binding agreements
- Not be prohibited from using the Platform under applicable law
3. Use of the Platform
3.1 Permitted Uses
You may use the Platform to:
- Browse and discover events
- Purchase tickets and register for events
- Create and manage events (if you are an Organizer)
- Communicate with other users through Platform features
- Access Islamic-specific features and content
3.2 Prohibited Uses
You may not:
- Use the Platform for illegal activities or to violate any laws
- Create events that promote hate speech, discrimination, or violence
- Infringe on intellectual property rights of others
- Create events that violate Islamic principles or mislead Muslim attendees about religious content
- Impersonate any person or organization, or misrepresent your identity, affiliation, or authority to act
- Create or operate more than one account in order to evade a restriction, limit, fee, or enforcement action
- Interfere with, probe, or circumvent any security, verification, risk, or rate-limiting measure
3.3 Prohibited Financial Conduct
You additionally may not use the Platform, any event, any listing, or any payment account connected to the Platform to do any of the following. This applies whether you act alone or with others, and whether or not the conduct is successful:
- Self-dealing transactions. Purchase tickets to your own event, or arrange for another person to do so on your behalf or for your benefit, other than a genuine purchase made in good faith and disclosed to us on request
- Payment instrument testing. Submit transactions in order to determine whether a payment instrument is valid, active, or usable, including through repeated, small-value, or rapidly repeated attempts
- Unauthorized payment instruments. Use, or accept payment from, any payment instrument you are not authorized to use, or that you know or ought reasonably to suspect was obtained unlawfully
- Fictitious or non-genuine events. List, publish, or accept payment for an event that you do not genuinely intend to hold, that does not exist, or that you have no reasonable ability to deliver
- Processing unrelated payments. Use the Platform to process payments for goods, services, causes, or activities other than the event described in your listing
- Artificial transaction activity. Generate transactions, refunds, or transaction volume that do not reflect genuine ticket sales, including to build transaction history, influence risk assessment, affect published metrics, or obtain access to features, limits, or funds
- Refund and dispute manipulation. Use refunds, cancellations, or chargebacks to conceal activity, to influence dispute or refund ratios, or to obtain funds you are not entitled to
- Circumventing settlement controls. Manipulate event dates, event status, ticket types, pricing, or any other information in order to accelerate, increase, or otherwise affect the release of funds
- Concealment and structuring. Divide, disguise, or route activity across multiple accounts, events, or organizations to avoid detection, limits, or review
- Money laundering and sanctioned activity. Use the Platform in connection with the proceeds of crime, terrorist financing, or any activity subject to applicable sanctions or trade restrictions
3.4 Misuse of Connected Payment Accounts
Where you connect a payment account provided by one of our payment partners in order to receive funds, that account is provided to you for the sole purpose of receiving proceeds from genuine ticket sales for events you organize. You agree that you will not:
- Open or operate a connected payment account using false, borrowed, stolen, or another person's identity or details
- Nominate or maintain a bank or settlement account that you are not the lawful holder of, or entitled to operate
- Permit any other person to use, control, or direct your connected payment account
- Open multiple connected payment accounts to evade limits, holds, reviews, or enforcement action
- Provide false, incomplete, or outdated information in response to identity, business, or source-of-funds verification
- Use the connected payment account to receive funds unrelated to events you genuinely organize on the Platform
- Fail to notify us promptly of any change to your identity, ownership, control, or settlement details
Our payment partners impose their own terms on connected payment accounts. Those terms apply to you in addition to these Terms. Where the two differ in respect of the connected payment account, the payment partner's terms govern that account.
4. Islamic Features and Compliance
4.1 Halal Verification
Halal food claims are made by individual event organizers. We do not independently verify halal certifications. Users should verify halal compliance directly with organizers if required.
4.2 Prayer and Religious Accommodations
Prayer space and religious accommodation information is provided by organizers through our Islamic features system. Users should verify prayer facilities and timing with event organizers.
5. Payment and Financial Terms
Qariyb charges fees for platform services including:
- Service fees for ticket transactions (disclosed at checkout)
- Payment processing fees (passed through from payment providers)
- Platform fees for event organizers (detailed in separate Organizer Agreement)
6. Fraud Prevention and Platform Integrity
6.1 Monitoring and Risk Assessment
To protect attendees, organizers, our payment partners, and the Platform, we monitor accounts, events, listings, and transactions for indicators of fraud, abuse, and other prohibited conduct. This includes automated analysis of transaction patterns, account and device information, and relationships between accounts, events, and payment instruments.
We may assign risk indicators to accounts, events, and transactions, and may apply the measures described in section 7 where our assessment, applicable law, or the requirements of a payment partner or card network warrant it. Automated analysis may inform these decisions; section 6.3 explains your rights in relation to those decisions.
6.2 Verification and Information Requests
We may require you to verify your identity, your organization, your entitlement to a payment or settlement account, the genuineness of an event, or the source or destination of funds, at any time. We may do this before enabling a feature, before releasing funds, or at any point afterwards.
You agree to provide the information and documentation we reasonably request, within the time we specify, and to ensure it is accurate and complete. Where you do not, we may apply the measures in section 7. We may share information with payment partners, financial institutions, card networks, and, where appropriate or legally required, regulators and law enforcement.
6.3 Automated Decisions and Human Review
Some measures may be applied automatically where the indicators are sufficiently clear, so that we can act quickly to prevent loss. Where a decision is made solely by automated means and produces legal effects for you or similarly significantly affects you, you may, to the extent applicable law provides, request human review of that decision, express your point of view, and contest the outcome. 7. Investigation, Suspension and Enforcement
7.1 Measures We May Take
Where we reasonably suspect prohibited conduct, a breach of these Terms, a risk of loss to any person, or where we are required to do so by applicable law, a payment partner, or a card network, we may take one or more of the following measures, to the maximum extent permitted by applicable law:
- Withhold, delay, or place a hold on the release of funds, in whole or in part
- Suspend, limit, or reverse the ability to accept payments, issue refunds, or receive payouts
- Require additional verification before any further funds are released
- Hold a reserve against anticipated refunds, chargebacks, fines, or other liabilities
- Cancel tickets or orders, and refund attendees, including where you have not requested it
- Unpublish, restrict, or remove an event, listing, or account
- Suspend or terminate your account and any connected payment account
- Report the matter to payment partners, financial institutions, card networks, regulators, or law enforcement
Where practicable and lawful, and where doing so would not prejudice an investigation or increase the risk of loss, we will tell you what measure we have taken and why, and how you may respond. Some measures may be applied without prior notice where delay would create a risk of loss or where notice is prohibited.
7.2 Your Responsibility for Losses
You are responsible for refunds, chargebacks, reversals, fines, penalties, assessments, and related fees and costs arising from your events, your listings, your account, or any breach of these Terms by you, together with our reasonable costs of investigation and recovery. To the maximum extent permitted by applicable law, you will indemnify us against loss we suffer as a result of prohibited conduct by you.
7.3 Recovery of Amounts Owed
Where you owe us an amount under these Terms, we may recover it, to the maximum extent permitted by applicable law, by any one or more of the following means:
- Deducting or setting it off against funds we hold for you, or that later become payable to you, whether in respect of that event or any other
- Deducting or setting it off against the balance of any connected payment account
- Reversing a payout or transfer, or instructing our payment partner to do so
- Applying a reserve we hold
- Charging a payment method you have provided to us
- Initiating a pre-authorized debit, direct debit, or equivalent payment instruction against the settlement account you have nominated
- Invoicing you for the amount, payable within 14 days
Authorization. You authorize us, and our payment partners acting on our instruction, to take the steps set out above in respect of amounts you owe us, including debiting the settlement account you have nominated. This authorization continues until all amounts owed are paid and your account is closed. Where applicable law or the rules of a payment system require a specific form of mandate, authorization, notice, or disclosure before such a debit may be taken, we will obtain or provide it, and this paragraph operates only to the extent that applicable law permits. Nothing in this section requires you to authorize a debit where applicable law prohibits you from doing so.
7.4 Effect of Termination
Termination does not affect any right or obligation that has already accrued, including our right to recover amounts owed and your obligation to honor commitments made to attendees. Sections concerning prohibited conduct, responsibility for losses, recovery of amounts owed, liability, and dispute resolution survive termination.
8. Disclaimers and Limitation of Liability
Important Notice:
The Platform is provided "as is" and "as available" without warranties of any kind. We are not responsible for the quality, safety, or legality of events. Event information is provided by organizers and may be inaccurate.
9. Governing Law and Dispute Resolution
9.1 Governing Law
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of England and Wales. Where you contract with us as an individual rather than in the course of a business, this choice of law does not deprive you of the protection of any mandatory provision of the law of the country in which you are habitually resident that cannot be varied by agreement.
9.2 Resolving a Dispute
For any dispute arising from these Terms or your use of the Platform:
- Direct Communication: First attempt to resolve the dispute directly with the other party
- Contact Us: If that does not resolve it, contact us using the details in section 13 so that we can try to resolve it with you
- Mediation: Where the dispute remains unresolved, the parties may agree to participate in good faith mediation before commencing proceedings
- Islamic Mediation: For disputes involving Islamic religious matters, parties may request mediation by qualified Islamic scholars
9.3 Forum
The courts of England and Wales have jurisdiction to determine any dispute arising out of or in connection with these Terms. Where you contract with us as an individual rather than in the course of a business, nothing in this section affects any right you have under mandatory law to bring proceedings in, or to be sued only in, the courts of the country in which you are habitually resident.
Nothing in this section prevents either party from applying to any court of competent jurisdiction for urgent injunctive or other interim relief, or prevents us from bringing proceedings to recover amounts owed to us in any jurisdiction where you are located or hold assets.
10. International Use and Compliance
Qariyb is available internationally and serves Muslim communities worldwide. Users are responsible for compliance with their local laws and regulations. Where applicable and legally permissible, Qariyb seeks to accommodate Islamic law (Sharia) principles in Platform features and dispute resolution.
11. Interpretation, Severability and General
11.1 Reading Down Rather Than Striking Out
Each provision of these Terms applies only to the extent permitted by applicable law. Where any provision, or part of a provision, would be unlawful, void, or unenforceable in a given jurisdiction or in a given case, it is to be read as narrowed, limited, or modified to the minimum extent necessary to make it valid and enforceable, and only if it cannot be so read is it to be severed. Severing a provision does not affect the validity of the remainder of these Terms.
11.2 Mandatory Rights Preserved
Nothing in these Terms excludes, restricts, or modifies any right, guarantee, warranty, or remedy that applicable law confers on you and that cannot lawfully be excluded, restricted, or modified by agreement. Where these Terms would otherwise do so, they are to be read as not doing so. This applies in particular where you contract with us as an individual rather than in the course of a business.
11.3 No Waiver
If we do not exercise or enforce a right or remedy available to us, that is not a waiver of that right or remedy, and does not prevent us from exercising or enforcing it later.
11.4 Order of Precedence
These Terms operate alongside our Privacy Policy, Payment Processing Terms, Event Organizer Agreement, and Attendee Terms. Where a conflict arises on a matter dealt with specifically in one of those documents, that document governs that matter. Where a conflict arises on any other matter, these Terms govern.
12. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you via email or Platform notification. The updated Terms will be posted on the Platform with a new "Last Updated" date.
